INFORMATION ON THE PROCESSING OF PERSONAL DATA

Pursuant to Art. 13, Legislative Decree 196/2003 and subsequent amendments introduced by EU Regulation 2016/679, (known as GDPR), hereinafter "the Regulation",  MO.DES S.R.L. wishes to inform you that Legislative Decree no. 196 of 30 June 2003 ("Personal Data Protection Code"), subsequently amended General Data Protection Regulation (EU Regulation 2016/679) provides for the protection of persons and other subjects with respect to the processing of personal data necessary to respond to your Request for information. The use of your personal data by its appointed personnel will occur according to the purposes and methods indicated in this information.

PURPOSE OF DATA PROCESSING

Personal data will be collected and processed for the following purposes:

  • identify or contact the user for the provision of a service or the execution of the requested operations;
  • allow the user to benefit from a service, for example to receive information on and from MO.DES S.R.L.

The data, after express approval, may be sent and processed by external companies (Google Analytics) for the creation of statistics on the site's navigation flows. We would like to point out that if you are already our customers, we may send you commercial communications relating to the Data Controller's services and products similar to those you have already used, unless you disagree (art. 130 c. 4 Privacy Code).

DATA PROCESSING METHODS

Personal data is processed using automated tools for the time strictly necessary to achieve the purposes for which it was collected, and in any case, no longer than 10 years after the termination of the relationship for Service Purposes.

The personal data voluntarily provided by the user through the contact form on the website (e.g., name, surname, email address, phone number, message content) is processed by the Data Controller exclusively for the following purposes:

  • to manage and respond to information requests submitted by the user;
  • to provide support or clarification regarding products or services offered by MO.DES S.R.L.

Providing this data is optional; however, refusal to provide the mandatory fields will prevent the form submission and, consequently, the ability to receive a response.

The contact form is protected by an anti-spam system (Google reCAPTCHA), which may collect personal data from the user in accordance with Google's Privacy Policy and Terms of Service.

The data provided will not be used for direct marketing purposes, nor will it be disclosed or sold to third parties, unless strictly necessary to comply with legal obligations or with the user's explicit consent.

Data collected via the contact form will be retained for the time necessary to respond to the request and in any case no longer than 12 months from receipt of the message.

PRIVACY NOTICE AND FORM

In the event of establishing a new business relationship, MO.DES S.R.L. provides an information form in Word format to be completed and returned, containing the notice pursuant to Article 13 of Regulation (EU) 2016/679 (GDPR).

This form is intended to obtain consent for the processing of personal data for contractual, administrative, and tax purposes, as well as to comply with legal obligations. The form must be returned signed before starting the business collaboration.

The form is sent via email to the new contact and must be completed and signed before the activation of the commercial relationship.

Data collected through this form will be processed in accordance with applicable regulations, exclusively for the specified purposes, and in compliance with the principles of lawfulness, fairness, and transparency.

FREEDOM IN PROVIDING DATA

The user is free to provide his/her personal data or not. Failure to provide such data could however compromise the provision of the requested service.

USE OF DATA

The personal information collected on the sites may be stored and processed in Italy or in any other EU country in which MO.DES S.R.L. has service supply relationships (for example a web maintainer or an email provider).

CONTROL AND TRANSFER OF PERSONAL DATA

The data collected through both the site and by filling out forms, if necessary, or with the aim of achieving the purposes already declared, can be managed by a third party designated for this purpose, as external data controller and if deemed appropriate, communicated to their independent data controllers. To this end, appropriate security measures are taken to prevent data loss, illicit or incorrect use and unauthorized access. Personal data can be transferred abroad, within the EU.

As described in the following section, the user can access their personal data and express preferences on the ways in which they wish to be contacted.
MO.DES S.R.L. is authorized to disclose personal information, only if required by law, or in the event that there is a firm belief that such action is necessary to (a) comply with the law or to comply with the provisions of a legal act with the involvement of MO.DES S.R.L. or the site; (b) protect and defend the rights or property of MO.DES S.R.L., (c) act in exigent circumstances to protect the personal safety of the owner, users or services of MO.DES S.R.L.

ACCESS TO PERSONAL DATA (ART. 7. LEGISLATIVE DECREE 196, 30 JUNE 2003 and ART.17 EU Regulation/2016/679)

The user has the right, at any time, to obtain from the Data Controller (using the form provided by the Guarantor for the protection of personal data, www.garanteprivacy.it) communication on the existence or otherwise of personal data concerning him / her and be informed of their content, origin, verify their accuracy, or request that such data be integrated, updated or deleted (Right to be forgotten).
To exercise these rights, simply contact the Data Controller through one of the channels made available.

PERSONAL DATA PROTECTION

MO.DES S.R.L. is committed to unconditionally protecting the confidentiality of the personal information of users of the site.
The various technologies and protection procedures used are designed to protect personal information from unauthorized access, use or disclosure.
For this reason, personal information is stored on computer systems with limited access, located in controlled facilities. Furthermore, when highly confidential personal data is transmitted over the Internet, it is protected by encryption, for example with SSL (Secure Sockets Layer) protocol.
MO.DES S.R.L. furthermore, pursuant to Articles 33 and 34 of the Regulation, undertakes to communicate within and no later than 72 hours from the detection, any problem that may have introduced the loss, dissemination or compromise of the personal data collected (Data Breach).
Such communication will take place first of all to the competent guarantor authority, and, subsequently, also to the interested parties, in a personal manner or through public communication, depending on the size of the subjects involved.
